Dan McGrew and Sam Britt obtained summary judgment for their physician client in a case brought by an inmate, which alleged that the physician violated the inmate’s constitutional rights by withholding necessary medical treatment. Dan and Sam were able to show that there was no evidence to support the plaintiff’s allegation that the physician was deliberately indifferent to the plaintiff’s serious medical needs. To the contrary, the evidence showed that the physician appropriately treated the inmate during each visit. District Court Judge, Middle District of Georgia, Marc Treadwell agreed and granted the defendant’s motion for summary judgment.
