David Hanson and Sam Britt recently authored an Amicus Brief in support of Certiorari to the Supreme Court of Georgia on behalf of the Georgia Defense Lawyer’s Association. In the case before the Court, Plaintiffs amended an expert affidavit outside of the time periods afforded under O.C.G.A 9-11-9.1. The trial court rejected Plaintiff’s attempts to amend, but was overturned by the Court of Appeals of Georgia. David and Sam argued that the Court of Appeals erred in overturning the trial court’s decision because Plaintiff’s amendment did not comply with the specific provisions of O.C.G.A. 9-11-9.1 which were enacted to protect medical providers against frivolous litigation.
